Contact Form Sniper

These Terms of Service ("Terms") govern your use of Contact Form Sniper, including the website at contactformsniper.com, the web app, the API and the MCP connector (together, the "Service"). The Service is owned and operated by Sycamore Software LLC ("Sycamore Software", "we", "us").

By creating an account or using the Service, you agree to these Terms. If you are using the Service for a company, you confirm you have authority to bind that company, and "you" means both you and the company. If you don't agree, don't use the Service.

1. What the Service does

Contact Form Sniper lets you upload a list of websites you choose. For each site, the Service looks for a public contact form, drafts a short message with AI based on that site's public pages, shows you the draft, and, only after you approve it, submits it through that form on your behalf.

We don't sell lead lists, and we don't pick who you contact. Every recipient comes from a list you provide, and every message is sent at your direction.

2. Your account

You need an account to use the Service. You can sign in with Google or with an emailed sign-in link.
Keep your account and any API or MCP keys private. You're responsible for activity under your account.
You must be at least 18 and able to form a binding contract.
One free trial per person or business. Creating extra accounts to collect more free credits is not allowed.

3. Your responsibilities

You are responsible for:

Who you contact. You choose every website on your list and confirm you have a legitimate business reason to contact each one.
What you send. You review and approve every message before it is sent. Approved messages are your messages.
Following the law. You are responsible for complying with every law that applies to your outreach, including anti-spam, consumer protection, privacy and data protection laws (for example CAN-SPAM, the TCPA where relevant, GDPR, UK GDPR, CASL and state privacy laws).
Your data. Any list or data you upload must have been obtained lawfully and in line with the terms of its source.

We don't review your list or your messages for legality, and nothing we provide is legal advice.

4. Our built-in safeguards

The Service is built to respect website owners. You agree not to try to get around any of these:

No bot-protection bypassing. The Service never attempts to solve or evade a CAPTCHA, Cloudflare challenge or any other bot protection. If a form is protected, that site is skipped.
Honest identification. Our bot identifies itself with an honest user agent and does not use residential proxies or disguises.
Permanent opt-outs. Every message includes an opt-out link. Once a site opts out, no customer can contact it through the Service again.
Frequency limits. The same website won't be contacted about the same product more than once in 30 days.
No hidden fields. The Service does not fill hidden fields or tick consent boxes on the recipient's behalf.

5. Acceptable use

You may not use the Service to:

send anything unlawful, deceptive, harassing, defamatory, hateful, sexually explicit, or that impersonates another person or business;
send scams, phishing, malware, or links meant to harm the recipient;
contact a site that has told you or us not to contact it, or that clearly prohibits commercial messages through its form;
target government, emergency, healthcare-patient or children's services in a way that could interfere with them;
overload, disrupt or interfere with any third-party website or system;
resell or white-label the Service without a written agreement with us;
reverse engineer, copy or build a competing service from the Service, except where the law allows; or
use the Service with data obtained in breach of the law or another party's terms.

6. Credits, pricing and payment

The Service runs on credits. One credit is used for each message that is confirmed as submitted. Scans, drafts and failed or skipped submissions do not use credits.
New accounts receive free trial credits. We may change or end the free trial at any time.
Credit packs and plans are listed on our pricing page. Prices may change; changes don't affect credits you've already bought.
Payments are processed by Stripe. You authorize us to charge your payment method for the purchases you make. Monthly plans renew automatically until you cancel; you can cancel any time and keep access until the end of the paid period.
Purchased credits don't expire while your account is in good standing. Credits have no cash value and can't be transferred.

7. Refunds and chargebacks

Unused credits from a purchase can be refunded within 14 days of that purchase. Credits that have already been used can't be refunded.
To request a refund, contact us (Section 17) before opening a dispute with your bank. We keep a record of every submission (and, where available, a screenshot of the confirmation), which we may share with Stripe or your bank if a charge is disputed.
Filing a chargeback for a valid purchase is a breach of these Terms, and we may suspend the account while it is resolved.

8. AI-generated content

Drafts are written by AI and may contain mistakes. You are responsible for reading each draft and editing or rejecting it before approval. We don't guarantee that drafts are accurate, appropriate or effective.

9. No guarantee of results

We don't guarantee that any form will be found, that any submission will be delivered or read, or that you'll get replies, leads or sales. Websites can change, block or remove their forms at any time.

10. Monitoring, suspension and termination

We log activity (such as sites contacted, messages sent, opt-outs and complaints) to run the Service, prevent abuse and handle disputes.
If we receive complaints about your outreach, or believe your use breaks these Terms or the law or creates risk for us, recipients or other customers, we may pause campaigns, ask you to explain your use and the source of your list, or suspend or close your account.
If we close your account for a breach, unused credits may be forfeited. If we close it for any other reason, we'll refund unused purchased credits.
You can close your account at any time by contacting us.

11. Affiliate program

If you join our affiliate program, these Terms also apply, along with the program details shown when you join. In short:

Commissions are paid only on completed, non-refunded payments from customers you genuinely refer.
No commission is paid on your own accounts, accounts you control, refunds or chargebacks. Commissions are held for 30 days and reversed if the payment is refunded or disputed.
You may not bid on our brand name in paid ads, spam people with your link, or make false claims about the Service.
We may change or end the program, or remove an affiliate who breaks these rules. Unpaid commissions earned through a violation are forfeited.

12. Intellectual property

We own the Service, including its software, design and brand. We give you a limited, non-exclusive, non-transferable right to use it under these Terms. You keep ownership of the lists and content you provide, and you give us permission to use them only to run the Service for you.

Feedback you send us may be used without obligation to you.

13. Third-party services

The Service relies on third parties such as hosting, AI and payment providers, and on third-party websites you choose to contact. We aren't responsible for those third parties or their websites.

14. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that the Service will be uninterrupted or error-free, or that any particular use of it is lawful where you are.

15. Limitation of liability

To the fullest extent the law allows:

we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill; and
our total liability for any claim relating to the Service is limited to the amount you paid us in the 3 months before the claim arose.

Some places don't allow certain limits, so some of these may not apply to you.

16. Indemnity

You agree to defend and indemnify Sycamore Software and its owners and contractors against claims, fines, penalties and reasonable legal costs arising from your lists, your messages, your outreach, or your breach of these Terms or the law.

18. Disputes and governing law

These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-law rules. Before filing any claim, both sides agree to try to resolve it informally for 30 days by contacting the other.

If it isn't resolved, any dispute will be settled by binding individual arbitration administered by the American Arbitration Association under its consumer or commercial rules (as applicable), except that either side may bring an individual claim in small-claims court. Claims may only be brought individually, not as part of a class or representative action.

19. Changes and general terms

We may update these Terms. If a change is significant, we'll notify you by email or in the app before it takes effect. Continuing to use the Service after that means you accept the new Terms.
If part of these Terms can't be enforced, the rest still applies.
Not enforcing a right isn't a waiver of it.
You may not transfer your account or these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets.
These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Service.
Sections that by their nature should survive (including payment, intellectual property, disclaimers, liability, indemnity and disputes) survive the end of your account.
